“IDS PLUS – an app that rewards”

This statute (hereinafter referred to as the “Statute”) is the only document that fully and bindingly regulates the rules and conditions of the promotional competition (hereinafter referred to as the “Competition”). The abbreviated information, posts and promotional materials are for informational purposes only.

I. Organizer, announcer and contact details

The organizer and announcer of the Competition (hereinafter referred to as the “Organizer”):

The organizer is also the operator of the competition and ensures its administration, communication and delivery of prizes.

II. Purpose of the Competition

The purpose of the Competition is to promote IDS PLUS services, increase awareness of ticket purchase options via the IDS PLUS mobile application, and increase the number of buyers of subscription tickets (hereinafter referred to as “PCL”), single-use tickets (hereinafter referred to as “JCL”), 24 or 72-hour tickets (hereinafter referred to as “daily CL”) in the IDS PLUS mobile application.

III. Duration and venue of the Competition

The competition takes place during:

Start of the Competition: from 16. 2. 2026 (00:00)
End of Competition: until 1. 3. 2026 (23:59)

The competition is held via the website: https://www.idsplus.sk, the IDS PLUS mobile application and related online channels (Facebook, Instagram) of the Organizer. The competition takes place in the territory of the Slovak Republic.

IV. Contest Participants and Excluded Persons

A participant in the Competition may be a natural person who:

a) has a user account created in the IDS PLUS application,
b) meets the conditions of participation according to these Statutes,
c) agrees to these Statutes.

Participation in the Competition is intended for persons who have reached the age of 16.

The following are excluded from participation in the Competition:

a) persons in an employment or similar relationship with the Organizer and persons providing the Competition,
b) persons close to these persons within the meaning of Section 116 of Act No. 40/1964 of the Civil Code.),
c) persons who violate these Statutes or commit acts contrary to good morals.

V. Competition Mechanics and Participation in the Competition

The participant will participate in the Competition by:

a) performs account registration/verification in the IDS PLUS application and b) completes the activity listed below (hereinafter referred to as the “Competition Activity”).

A. Competitive activities

c) Every participant who has a valid PCL, JCL or daily CL in the IDS PLUS mobile application during the competition will be automatically included in the competition. Each participant receives one draw for each day on which they had a valid PCL, JCL or daily CL in the IDS PLUS mobile application.
d) Only non-cancellable or non-refundable tickets will be included in the draw.

The condition for participation in the Competition is a purchase made via the IDS PLUS mobile application.

B. Number of draws

a) Each participant receives one draw for each day they had a valid PCL, JCL or daily CL in the IDS PLUS mobile application.
b) The participant can receive a maximum number of draws in the Competition, i.e. 14 draws (since the Competition will last 14 days; one draw for each day they had a valid PCL, JCL or daily CL in the IDS PLUS mobile application).

C. Technical conditions

Only non-cancellable or non-refundable tickets duly registered in the IDS PLUS systems will be included in the draw. The organizer is not responsible for non-delivery or non-registration of the activity due to reasons on the participant’s part (e.g. malfunctioning device, incorrectly entered data, internet connection failure).

VI. Winnings

The Organizer is the provider of the prizes. The prizes are not legally enforceable; it is not possible to request their exchange for money or other consideration.

A total of 3 prizes will be awarded in the competition:

a) 1st prize: credit for the IDS PLUS mobile application worth €50,
b) 2nd prize: credit for the IDS PLUS mobile application worth €40,
c) 3rd prize: credit for the IDS PLUS mobile application worth €30.
The prize cannot be exchanged for cash.

VII. Determination of winners and drawing of lots

The Organizer will determine the winners by random drawing from all validly entered draws, namely:

a) Draw date: The draw of winners will take place no later than March 11, 2026. The winners will be contacted by an employee of the Organizer with a notification of their win within 10 working days of the draw date. b) Draw method: random selection of draws; an internal protocol will be drawn up about the draw.

Each draw can be a winning draw only once. One participant can win a maximum of one prize during the Competition, unless otherwise specified by the Organizer.

VIII. Announcement of winners and presentation of prizes

The Organizer will contact the winners via the details provided in the IDS PLUS account. The Organizer will contact the winners only by e-mail via the contact details provided in the IDS PLUS mobile application with which the winner participated in the Competition.

The winner is obliged to confirm receipt of the prize and provide the necessary cooperation for its delivery within five working days of being contacted. If the winner does not respond within the deadline or refuses to provide cooperation, the Organizer is entitled to determine a replacement winner.

The prize will be credited to the winner’s account in the IDS PLUS application in the form of a credit to a customer account that is active and has a correctly specified functional e-mail. For the avoidance of doubt, the Organizer declares that the prize in the form of a credit credited to the customer account in the IDS PLUS mobile application can only be used to purchase travel tickets. The credit cannot be paid out in cash, transferred to a bank account or otherwise reimbursed financially.

IX. Liability and complaints

The Organizer is not liable for damages incurred in connection with participation in the Competition or use of prizes, except in cases where liability cannot be excluded under mandatory legal regulations.

Complaints regarding the course of the Competition may be submitted in writing to the address specified in Art. I. within 15 days of the end of the Competition. Complaints are handled within a reasonable period of time, usually within 30 days.

X. Tax and contribution obligations

Tax and contribution obligations associated with prizes are governed by the generally binding legal regulations of the Slovak Republic. The organizer will provide the winner with appropriate assistance (e.g. confirmation of the value of the prize), if necessary.

If legal regulations require tax withholding or other performance by the Organizer, the Organizer shall proceed in accordance with the law.

XI. Personal data protection

The controller of the personal data of the Competition participants is the Organizer (data in Art. I.).

Purpose of processing: implementation of the Competition (registration, recording of draws, drawing, contacting winners, handing over prizes), resolving complaints and proving the legality of the Organizer’s actions.

Legal basis: performance of the contractual relationship (participation in the Competition) and the Organiser’s legitimate interest in preventing fraud; publication of the winner’s name/residence or use of the winner’s photograph for marketing purposes is only possible with specific consent.

Scope of data: identification and contact data (e.g. name, surname/username, e-mail), data on ticket purchases/PCL in the IDS PLUS application to the extent necessary for inclusion in the Competition, and, if applicable, the winner’s delivery address.

Retention period: during the duration of the Competition and subsequently for 6 months after its end for the purposes of complaints and proving legality; winners’ data necessary for accounting and tax purposes for the period required by special regulations.

Rights of data subjects: right of access, rectification, erasure, restriction of processing, portability (if applicable), right to object and right to file a complaint with the Personal Data Protection Office of the Slovak Republic.

Detailed information on the processing of personal data is contained in Annex No. 1 to this statute.

XII. Final provisions

The Competition is a promotional competition to support the use of IDS PLUS services and is not a game of chance pursuant to Act No. 30/2019 Coll. on Games of Chance, it is exclusively a promotional competition pursuant to Section 4, Paragraph 6, and payments made for the purpose of participating in the Competition or obtaining benefits from this Competition (including payments for travel tickets) are not considered a deposit pursuant to the aforementioned Act.

The Organizer reserves the right to shorten, interrupt, postpone or cancel the Competition, or to amend the Statutes, if necessary for reasons worthy of special consideration (in particular technical reasons, force majeure or fraud prevention). The amendment will be published in the same manner as these Statutes.

Legal relations not regulated by this Statute are governed by the legal system of the Slovak Republic.

Annex No. 1 – Information on the processing of personal data (GDPR)
This document contains information pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) on the processing of personal data of participants in a promotional competition (“Competition”) governed by the Statute.

1. Who is the controller?
The controller of personal data is the Organizer referred to in Article I of the Statute (Integrated Transport of the Žilina and Trenčín Regions, s.r.o.).

2. Contact details of the controller
The contact details of the controller for exercising the rights of the data subject are provided in Article I of the Statute (contact e-mail and contact address for complaints/notifications).

3. What data do we process?
In connection with the Competition, we may process in particular the following categories of personal data (to the extent necessary for the implementation of the Competition):
a) identification and contact data of the IDS PLUS account – name and surname, e-mail to which the account is registered, account identifier (numerical account ID), the Organizer does not store the telephone numbers of the participants for the purposes of the Competition.
b) data on the purchase of travel tickets in the IDS PLUS application to the extent necessary for inclusion in the draw (date/time from – until the validity of the travel ticket),
c) data on the course of communication with the participant/winner (e.g. confirmation of receipt of the prize, delivery of notifications),
d) data necessary to fulfill legal obligations (in particular accounting/tax obligations for winners).

4. For what purposes and on what legal basis do we process data?

We process personal data for the following purposes and on the following legal grounds:
a) Implementation of the Competition: registration/recording of draws, drawing, contacting winners, handing over prizes, legal basis: performance of the contract (participation in the Competition according to the Statute) and/or the legitimate interest of the operator in the proper conduct of the Competition.
b) Prevention of fraud, abuse and ensuring the integrity of the Competition, legal basis: legitimate interest of the operator.
c) Handling complaints and demonstrating the legality of the procedure, legal basis: legitimate interest of the operator and/or fulfillment of legal obligations under special regulations.
d) Fulfillment of accounting and tax obligations related to prizes (if applicable), legal basis: fulfillment of a legal obligation.
e) Publication of the winner’s identification: use of the winner’s photograph for marketing purposes, legal basis: consent of the data subject (if required under the Statute).

In the case of processing based on legitimate interest, the data subject may object; the assessment of the legitimate interest will be provided by the controller upon request.

5. Who is the recipient of the data?

Personal data may only be disclosed to the extent necessary to the following categories of recipients:
a) persons ensuring the administration of the Competition on the part of the operator,
b) contractual intermediaries of the operator (in particular providers of IT services and operation of the IDS PLUS application, hosting services, communication/email services),
c) professional employees or contractual partners of the operator bound by confidentiality (lawyer, accountant, economist),
d) public authorities, if required by law.

6. Transfer to third countries

In principle, the controller does not plan to transfer personal data outside the European Economic Area. However, if any of the service providers used were to process data outside the EEA, the transfer would only take place if the conditions of the GDPR were met (in particular on the basis of an adequacy decision or standard contractual clauses).

7. How long do we keep data?

The retention periods are based on the Statute (Art. XI) and the relevant legal regulations:
a) participant data: for the duration of the Competition and then, as a rule, 6 months after its end (complaints and proof of legality),
b) winner data: for the period necessary to deliver the prize and then for the period required by accounting and tax regulations.

8. What rights does the data subject have?

The data subject has in particular the right to access, rectification, erasure, restriction of processing, portability (if applicable), the right to object to processing based on legitimate interest and the right to withdraw consent (if processing is based on consent). Requests can be made to the contact person specified in Art. I of the Statute. The operator may require appropriate identity verification.

9. Right to file a complaint

The data subject has the right to file a complaint with the Personal Data Protection Office of the Slovak Republic if he or she believes that the processing of his or her personal data is in breach of the GDPR.

10. Obligation to provide data and automated decision-making

The provision of personal data is a contractual requirement to the extent necessary for participation in the Competition and for the award of the prize; if the participant does not provide the data, it may not be possible to include him in the draw or award him the prize. No decision-making based solely on automated processing is carried out within the Competition, which would have legal effects or similarly significantly affect the data subject; if automated steps are used (e.g. technical inclusion of draws), they serve exclusively for the administration of the Competition.
